Terms of Service

1. Who we are

These Terms of Service (“Terms”) are a contract between you and:

In these Terms, “we,” “us,” “our,” and “Flashcardly” refer to the company above. “You” refers to you, the person using the service.

2. What Flashcardly is

Flashcardly is a mobile app for language learning. It includes:

  • Structured lessons across multiple languages
  • Flashcard-based study with the Leitner spaced-repetition method
  • Four practice modes (word match, audio match, sentence builder, type-it-out)
  • Custom decks you create
  • Streaks, XP, levels, and achievements

The flashcardly.io website is marketing and support material. You don’t create an account on the website — accounts live in the mobile app.

3. Who can use Flashcardly

You must be at least 16 years old to use Flashcardly. By creating an account or using the service, you confirm that you meet this age requirement. If we learn that a user is under 16, we will close the account.

4. Your account

You need an account to access most of Flashcardly. You can create one with an email + password, with Apple Sign-In, or with Google Sign-In.

You’re responsible for:

  • Keeping your login credentials secure
  • Anything that happens on your account
  • Telling us at support@flashcardly.io if you suspect unauthorised use

One account per person. Don’t share, sell, or transfer your account.

5. Acceptable use

By using Flashcardly, you agree not to:

  • Reverse-engineer, decompile, or extract source code
  • Use automated scripts, scrapers, or bots against the service
  • Upload custom-deck content that is unlawful, infringes others’ rights, or contains hateful or harassing material
  • Use the service to distribute malware, phishing material, or spam
  • Circumvent our free-tier limits through multiple accounts or technical means

We may suspend or close accounts that violate these rules, with notice where practical.

6. Subscriptions and billing

Flashcardly has a Free tier and a Pro tier:

  • Free — 3 new lesson parts per day, unlimited reviews and practice, unlimited custom decks, 50 dictionary lookups per day, 5 AI grammar explanations per day, all 29 languages, all 4 practice modes on lesson content, and one streak freeze earned every 14 days.
  • Pro — unlimited new lessons, unlimited AI grammar explanations, AI-generated decks (up to 10 per day), practice modes on your own decks, 500 dictionary lookups per day, a streak freeze earned every 7 days (up to 2 held), and priority support.

The current limits are always shown in the app and may change over time; any change to a paid feature will not reduce what you have already paid for during the current billing period.

6.1 Merchant of record

Pro is sold exclusively through the Apple App Store (on iOS) and Google Play (on Android). The contract for the payment itself is between you and:

  • Apple Distribution International Ltd. for iOS purchases, or
  • Google Commerce Limited / Google LLC for Android purchases.

We don’t take payments directly and we don’t see your card, billing address, or other payment credentials. All billing, pricing, taxation, and payment disputes are handled by Apple or Google under their respective terms.

6.2 Auto-renewal

Pro subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the renewal date. You can turn off auto-renewal in your Apple ID or Google Play account settings at any time.

6.3 7-day free trial

New Pro subscribers are eligible for a 7-day free trial on their first annual subscription, where the store offers it. If you don’t cancel before the trial ends, the subscription starts automatically and the first billing period is charged. You can cancel during the trial with no charge.

6.4 Cancellation

Cancel anytime in your Apple ID or Google Play subscription settings. You keep Pro access through the end of the current billing period. We don’t prorate partial periods — this follows Apple’s and Google’s policies.

6.5 Refunds and right of withdrawal

Refund requests go through Apple or Google per their policies:

We cannot issue refunds directly. Under EU consumer law (Directive 2011/83/EU, implemented in Czech law via §1829 of Zákon č. 89/2012 Sb., the Czech Civil Code), EU consumers generally have a 14-day withdrawal right for digital services. By starting Pro immediately at the moment of purchase, you expressly consent to us beginning performance before the 14-day period ends — and acknowledge that you lose the withdrawal right for the already-performed portion. This consent is captured in the Apple or Google purchase flow at the moment of subscription.

7. AI-Generated Content

Flashcardly utilizes Google Cloud Gemini to pre-generate portions of its content, including contextual grammar explanations, synthetic audio voices, and selected visual images.

Users do not interact with a live AI system; all AI-assisted content is statically compiled before being served. In compliance with the EU AI Act (Regulation (EU) 2024/1689), we explicitly disclose that these assets are generated by an AI system. While we strive for high educational accuracy, AI systems can occasionally produce errors or unusual artifacts. If you encounter incorrect language data or concerning content, please utilize the in-app “Report word” feature so our human curation team can review it.

8. Your content (custom decks)

When you create a custom deck in the app, you own the words, translations, and any content you add. By using Flashcardly, you grant us a worldwide, royalty-free, non-exclusive license to host, display, back up, and synchronise your custom decks solely for the purpose of running the service on your devices. This license ends when you delete the deck or close your account.

You are responsible for the content you upload. Don’t upload anything that infringes someone else’s rights or that is unlawful under Czech or EU law.

9. Our intellectual property

The Flashcardly app, the flashcardly.io website, visual branding, logo, mascot, and the name “Flashcardly” belong to us or our licensors. Czech and EU copyright, trademark, and database-rights law protects it.

Please note that we do not claim standard copyright ownership over purely AI-generated assets, except as incorporated into the broader design and database structure of our service.

Using Flashcardly gives you a personal, non-transferable, non-sublicensable license to use the service for your own language learning. Nothing more. You may not:

  • Resell, republish, or sublicense our content
  • Use our name, logo, or mascot without our written permission (except for news and commentary, which is fair use)
  • Circumvent any technical protection measures

10. Third-party services

Flashcardly integrates with third-party services whose own terms apply:

We’re not responsible for these services. Issues with Apple or Google billing should be raised directly with them.

11. Service availability and changes

We work hard to keep Flashcardly running, but we don’t promise 24/7 uninterrupted service. We may:

  • Perform maintenance (we try to announce major windows in advance)
  • Fix bugs, change features, or retire features that don’t serve users well
  • Update translations, audio, or curated content as we improve the library

If we retire a feature that was promised in the Pro tier before the end of your paid period, and the feature was material to your decision to subscribe, you may request a prorated refund via Apple or Google per their policies.

12. Disclaimers

Flashcardly is provided “as is” and “as available.” We don’t promise:

  • That you’ll reach any specific level of fluency — language learning depends on you
  • That every translation, audio clip, AI-generated explanation, or curated deck is free of errors — if you spot one, use the in-app “Report word” feature
  • That the service will be error-free or uninterrupted

To the maximum extent allowed by Czech law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement).

13. Limitation of liability

To the maximum extent allowed by Czech law, our total liability for any claim related to Flashcardly is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability for:

  • Gross negligence or intentional harm
  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under Czech or EU law

14. Termination

14.1 You ending the relationship

You can delete your account anytime in Profile → Settings → Danger Zone → Delete Account & Data or on our delete-account page. Deletion is effective immediately; residual copies in encrypted backups are rotated out within 90 days (see Privacy Policy §6).

14.2 Us ending the relationship

We may suspend or close your account if you:

  • Violate these Terms
  • Use the service in a way that puts other users or the service at risk
  • Commit fraud or payment chargebacks without legitimate cause

Where practical, we give notice and an opportunity to cure. We don’t suspend paid accounts for minor or resolvable issues.

15. Changes to these Terms

We may update these Terms. For material changes, we will:

  • Announce the change in-app when you next open the service
  • Email the address on your account
  • Wait at least 30 days before the new version takes effect

Continued use of the service after the new version takes effect means you accept it. If you don’t accept the changes, you can cancel your subscription and close your account before the effective date.

16. Governing law

These Terms and any non-contractual obligations arising from or connected with them are governed by the laws of the Czech Republic, without giving effect to any choice-of-law rules that would apply a different jurisdiction. Nothing in this clause limits any mandatory consumer protections available to you under the law of the EU member state where you habitually reside.

17. Dispute resolution

17.1 Contact us first

If you have a dispute, email support@flashcardly.io or legal@flashcardly.io. Most issues are resolved within a few emails.

17.2 Out-of-court resolution (for EU consumers)

If we can’t resolve it directly, EU consumers can use the Czech Trade Inspection (Česká obchodní inspekce):

17.3 EU ODR platform

EU consumers may also use the European Commission’s Online Dispute Resolution platform:

17.4 Courts

Otherwise, disputes go to the competent courts of the Czech Republic (typically the court with jurisdiction over our registered office).

18. General

  • Severability: If any clause of these Terms is unenforceable, the rest remains in effect.
  • No waiver: Our failure to enforce a right doesn’t waive it.
  • No assignment: You may not assign these Terms; we may assign them to an affiliate or successor as part of a corporate reorganisation or acquisition, on notice.
  • Entire agreement: These Terms + the Privacy Policy form the entire agreement between you and us regarding Flashcardly, and supersede any prior agreements.
